The Incredible Tales of Brittany Commisso: No Sex, but Lies and Videotapes

An Executive Chamber staff member noted that she believed Executive Assistant #1 [Brittany Commisso] and Ms. McGrath had wanted a picture with the Governor at the party and were proud of the ones taken.” AG report p. 20, footnote#123.

She was kind of like starry-eyed high school kid with her like she was a little bit star-struck. But she very much wanted to get to him when she could […] She would come into the office, you know, with a cup of coffee that no one had asked for, try to walk right back there with it […] there is no one else who I can think of who […]ever brought him an unsolicited coffee.” Stephanie Benton Testimony, p. 388–390.

None of this was mentioned by AG Letitia James when she pompously announced the findings of her sham investigation and accused Governor Andrew Cuomo of being a serial harasser who groped accuser Brittany Commisso. Neither did she mention that Brittany Commisso’s and her best friend Alyssa McGrath’s testimonies revealed inconsistencies that raised huge red flags in terms of their credibility. Nor was she concerned about Commisso’s obvious motives to lie, Cuomo’s lack of opportunity to grope her as she claimed, and evidence contradicting Commisso’s constantly changing story.

In late 2020 Brittany Commisso told Cuomo that she was going through a divorce which created financial pressure for her. She then spoke to her supervisors, also in late 2020 and again in early 2021, asking for a raise and more overtime hours on the weekends. Her husband filed for divorce on February 22, 2021 (summons with notice at Albany County Clerk with Brittany Commisso as defendant). This was right before Lindsey Boylan (2/24) and Charlotte Bennett (2/28) accused Cuomo (in collusion, as evidenced by messages and testimonies) of improprieties. A few days later, on March 3, 2021, Commisso jumped on the bandwagon and started to tell co-workers that she had inappropriate conversations with Cuomo and that he had touched her. Until then, she had never mentioned anything of this nature to anyone, including her best friend since high school, Alyssa McGrath, and had acted as described in the witness statements quoted above. The following weekend, she developed her story further and told coworkers that Cuomo had groped, kissed her and thrown her against the wall, well knowing they would be reporting her claims. She obtained a personal injury lawyer, who contacted the Executive Chamber the day after, March 9, who emphasized that she was filing an administrative complaint; that is, she was looking for a financial settlement, and did not pursue a criminal complaint (which of course, as has been shown, would trigger a real investigation and thus fail).

So much for Commisso’s motive. Now let’s look into her tales and the evidence. She claimed Cuomo groped her in December 2019 and November 2020. There are no witnesses and what is presented as evidence supports Cuomo, not her. She provided different versions on different occasions and contradicted herself repeatedly and significantly.

According to Commisso, Cuomo grabbed her breast (under her shirt, but over her bra) in late 2020. She stated that she couldn’t remember the exact date of this significant incident, which was not traumatizing enough for a grown-up woman to cause memory loss. What she said — thus of course making it much harder to prove she lied — was that the incident happened “around” the day she was tasked to take a photo of the document. The photo she provided was dated November 16th. Blackberry PIN messages used by the Protective Services Unit to announce visitors confirmed that Commisso was there on November 16, 2020. So, Letitia James’ “investigators” established that Cuomo had groped Commisso on that day WITHOUT INVESTIGATING, verifying information and asking witnesses who were present in the Executive Mansion on November 16.

After the AG announced the findings of her result and published the report, Cuomo’s attorney provided a detailed timeline of activities on November 16, 2020, which irrefutably proved the incident could not have happened that day. Two days later on August 5, Brittany Commisso filed a criminal complaint at the Sheriff’s Office (instead of the Police Department), ten days before she had her next court date regarding her divorce, which developed not only into a fight for money, but also over custody. Being exposed as a liar along with the selfie in which she throws herself at Cuomo and which was published with the report was damaging for her case, so it seems she was trying to save her credibility by digging herself deeper.

On August 9, 2021, the Times Union’s anti-Cuomo writers suddenly claimed that Commisso had told them in March and April that the alleged incident took place around the 25th of November 2020. But state records showed that the 16th was the only day in that month that Commisso was in the Mansion. Another date that did not work out to support her tale.

On October 28, 2021, an investigator for Albany County Sheriff Apple filed criminal charges against Cuomo in Albany City Court for this incident, establishing December 7, 2020 (most likely the day she asked for a raise and overtime), as the new date of this alleged “forcible touching”, much to the surprise of DA David Soares as well as Commisso’s lawyer, who both issued statements saying how surprised they were. Less surprisingly for Letitia James, who announced her candidacy for Governor the very next day. Was Brittany Commisso — after attempting to use Cuomo to fulfil her financial needs — used as a political pawn? On November 4, 2021, District Attorney David Soares sent a letter (Page#1 & Page#2) to the Albany City Court calling the complaint “potentially defective” because it did not include a sworn statement by the victim, but instead included a portion of a statement she gave without oath in another proceeding, and “even more troubling”, excluded other portions of her testimony. Quote: “This portion of the transcript has now been provided to the defense counsel due to its exculpatory nature.” Soares declined to prosecute Cuomo in January 2022.

Next, the evidence. On November 10, 2021, AG James released Commisso’s testimony, which revealed that Brittany Commisso wore a long winter coat while she was allegedly groped. This crucial fact was discussed during the testimony and completely omitted by the AG and her investigators in the report. Commisso specifically points out that she didn’t take it off because she was going back to the office right away. Then the investigators start asking questions about her coat because wearing it doesn’t fit her narrative of Cuomo sliding his hand “instantly” and in “.2 seconds” under her blouse. If you listen to this portion of her testimony, it becomes obvious that the investigators realize this and ask her leading questions to give her the opportunity to correct herself. Commisso’s story crumbles — she suddenly claims that she took her coat off, but then put it back on, and ends up saying she definitely had her coat on when Cuomo slid his hand under her blouse. The investigators start asking about her blouse but quickly stop her from further contradictions and exposing her by saying “it’s fine”. IT IS NOT FINE. A real investigator who wants to get to the truth, would want to understand how someone slides his gigantic hand underneath the blouse (from the bottom) of a much shorter woman who wears a coat within .2 seconds. Was Commisso, who is always seen in fitted tops, suddenly wearing a tent or a flowy summer blouse in the middle of winter?

Letitia James and her hench(wo)men omitted this entire part of the testimony in their “report”. Governor Cuomo never groped Commisso and they knew he didn’t. They mislead the public on purpose.

Commisso’s second claim is that on December 31, 2019, Cuomo asked her to take a selfie with him, during which he rubbed and grabbed her butt for at least 5 seconds. As evidence, she submitted a photo which was taken AFTER the alleged incident, in which she leans her head against him, has her hand around his neck, resting on his shoulder, and smiles confidently, happily, and like she just won a trophy. Cuomo looks — understandably as this was the time of holiday events, speeches, and most importantly preparing for the State of the State speech — tired and beaten up. The selfie was taken on Commisso’s phone, indicating that she was the initiator. If Cuomo wanted the photo or wanted to exercise power, he would have used his phone. If he was doing anything inappropriate, he would not leave a photo of it as evidence on the phone of his “victim”.

Commisso claims that she took several photos before the alleged groping, but that she deleted them because they were blurry. She told two contradictory stories about the reason she deleted these blurry photos which would have been evidence. In her testimony on May 17, 2021, she claimed she deleted them because she didn’t want Cuomo to see how shaky and nervous she was. In her CBS interview on August 9, 2021, she said that she did show him the blurry pictures and HE said “those aren’t good” and to take new ones. In her CBS interview, Commisso claimed that after the butt grope they sat down on the couch, where she felt safer, when in fact it puts her in a more vulnerable position. After the incident, she then sent the selfie to her best friend Alyssa McGrath, but as can be seen from the photo she took the time to photo-shop or filter it while still sitting next to her “assailant”. Her and Cuomo’s forehead wrinkles are clearly smoothened out / significantly reduced and his hairline moved back by doing so.

More damning is Alyssa McGrath’s testimony about the selfie and the text messages the two women then exchanged. After Commisso sent the selfie to McGrath, her friend responded: “Um where is my pic!! I’m officially jealous!!! I need to be photoshopped into the right of him 🤣 Love this so much”. When asked during her testimony why she wrote this, she explains “I felt like I needed to say that considering she was with him and he wanted — he asked that it be sent to me.” When asked how she knew that she was with him, she responds “I knew AFTER the fact when she told me.” (Commisso allegedly called her after she left the mansion). It is clear from the reaction of the investigator (watch the video!) that they catch the lie, yet they did not follow up and moved on, letting her get away with it and then deemed her credible in the “investigative report”.

Commisso has a motive. Cuomo has not. Why would he risk a 40-year long career of public service, his reputation and his family name to touch the butt and breast (over the bra at that!) of a random employee for a few seconds? This might be exciting and gratifying for a teenager controlled by his pubertal hormones, not for a grown-up man on the pinacle of his popularity, pursued by hordes of willing women. Evidence and witness statements support Cuomo, not Commisso. That’s why they were ignored, omitted and hidden by Joon Kim, Anne Clark, and Letitia James, who shall be the topic of another post.
